Special ANC 8(a) Advantages

An 8(a) company owned and controlled by an ANC may be awarded a direct award 8(a) contract where the anticipated value of the procurement exceeds the applicable competitive threshold if SBA has not accepted the requirement into the 8(a) BD program as a competitive procurement.

There is no requirement that a procurement must be competed whenever possible before it can be accepted on a direct award basis for an ANC-owned concern.

ANCs, unlike other 8(a) companies, provide the government with a virtually unlimited direct award ceiling. SBA may award a direct award 8(a) contract to an ANC with a value up to $25M for federal agencies ($100M for DoD) without a Justification and Approval (J&A). There is no dollar threshold for a direct award with an approved J&A.

ANC 8(a) companies eligible for a direct award or competitive 8(a) requirement may not be challenged by another participant or any other party, either to SBA or any administrative forum as part of a bid or contract protest.

An 8(a) firm is a small business that is owned and operated by socially and economically disadvantaged citizens and has been accepted into the 8(a) Business Development Program. This program is administered by the Small Business Administration (SBA), the United State agency charged with supporting the growth and development of small businesses.

The 8(a) program is designed to provide a level playing field to help disadvantaged entrepreneurs get government contracts and access to the economic mainstream in America.

For example, in FY2020, 8(a) firms were awarded $34.0 billion in federal contracts, including $9.3 billion in 8(a) set-aside awards and $11.1 billion in 8(a) sole-source awards.

Direct Award contracts are a way to award certified 8(a) companies with a contract without going through the long RFP process. A Contracting Officer can award a contract to a single contractor under the 8(a) program if the following apply:

  • A determination that the 8(a) company is a responsible vendor
  • The contract can be awarded at a fair market value
  • The total value of the contract doesn’t exceed the price threshold

A DoD contractor that subcontracts with a firm that is 51% or more Native American-owned is entitled to receive a rebate equal to 5% of the amount of the subcontracted award.
